Terms of Service for Lily Kadera Photography (LKP)

We are Lily Kadera Photography (‘Business’, ‘we’, ‘us’, or ‘our’), a business that began development in September 2018.

Effective Date: January, 2025

These Terms of Service ("Agreement") are a legally binding agreement between you ("Client," "Customer," or "you") and Lily Kadera Photography ("LKP," "Photographer," "we," "us," or "our"), an individual business providing professional photography services, print sales, and an online portfolio for potential clientele. By accessing or using our website, purchasing prints, or booking photography services, you agree to comply with and be bound by these Terms of Service.

1. Services Provided Lily Kadera Photography offers the following services:

  • Photography Services: Professional photography for portrait sessions, restaurants and performers.

  • Print Sales: High-quality prints of photographs available for purchase via our online store.

  • Online Portfolio: A portfolio of the Photographer's work presented on the website to showcase examples of LKP’s work to clientele.

2. Booking Photography Services a. Booking Process: To book photography services, the Client must complete the booking form on the website and pay the required deposit (if applicable). Bookings are not confirmed until the deposit is received. b. Deposit and Payment Terms: A non-refundable deposit of £20 is required to secure your session if located outside of East Anglia, UK (Norfolk, Suffolk, Essex and Cambridge). The remaining balance for photography services is due up to 14 days after the scheduled session or event, unless otherwise agreed in writing. c. If we do not receive payment by the 14 days, there will be a late payment fee of £10 and so forth if the due date is not met. Cancellation/Rescheduling: If you wish to cancel or reschedule your booking, the deposit is non-refundable if notified less than 48 hours prior. If rescheduling occurs, we will make reasonable efforts to accommodate the new date, subject to availability.

3. Print Sales Terms a. Purchasing Prints: You may purchase prints of photographs through our online store. Prints are sold as high-quality reproductions of the images, available in various sizes and formats. b. Payment and Delivery: Upon confirmation of your order, payment is due immediately. We accept payment through Visa, Mastercard and American Express. Once payment is confirmed, your prints will be processed and shipped to the delivery address provided. Delivery times and costs will vary based on your location. c. Returns and Refunds: Due to the custom nature of print orders, we do not offer refunds for prints unless the item is defective or damaged during delivery. If you receive a damaged or incorrect item, please contact us within 14 days of receiving the item for assistance.

4. Online Portfolio a. Display of Work: The online portfolio showcases a selection of Lily Kadera’s work. The content is provided for informational purposes only to introduce LKP to clientele with the range of services offered and how we can be contacted. b. Intellectual Property: All images and content displayed in the portfolio are protected by copyright. You may not reproduce, distribute, or use any of the images for commercial purposes without obtaining written permission from Lily Kadera Photography.

5. Client Responsibilities a. Cooperation: The Client agrees to cooperate and follow the Photographer’s instructions during any photography session to ensure a smooth process and optimal results. b. Location Access: The Client is responsible for ensuring that the location or venue for any photography session is accessible and suitable. Any additional fees or permits for the location are the Client's responsibility. c. Punctuality: The Client agrees to arrive on time for all scheduled sessions or events. Late arrivals may result in a reduction of session time.

6. Image Delivery and Usage Rights a. Delivery of Images: Edited images will be delivered via an online gallery or other method as specified in the service agreement. Delivery will occur within 1-2 weeks from the session date, depending on the type of service. b. Copyright and License: All images remain the copyright property of Lily Kadera Photography. Upon completion of the session, the Client is granted a non-exclusive, non-transferable license to use the images for personal purposes only, unless otherwise agreed in writing. c. Commercial Use: The Client may not use the images for commercial purposes without obtaining prior written consent from Lily Kadera Photography.

7. Image Use for Marketing The Client grants Lily Kadera Photography permission to use images created during photography sessions for marketing purposes, including but not limited to the Photographer’s website, social media, portfolio, and promotional materials. The Client may request that specific images not be used for these purposes and can purchase full ownership at an agreed rate.

8. Privacy and Data Protection Lily Kadera Photography will handle any personal data provided by the Client in accordance with applicable privacy and data protection laws. We will not sell, rent, or lease personal information to third parties. 9. Limitation of Liability a. Photographer's Liability: In the event the Photographer is unable to provide the agreed services due to illness, accident, or equipment failure, a full refund of the deposit will be provided, or the session will be rescheduled at no additional charge. b. Force Majeure: Lily Kadera Photography is not liable for any failure to perform due to circumstances beyond our control, including but not limited to natural disasters, strikes, or other force majeure events. c. Limitation of Damages: Under no circumstances will Lily Kadera Photography’s liability exceed the total amount paid by the Client for the relevant service.

10. Governing Law These Terms of Service shall be governed by and construed in accordance with the laws of England. Any legal action or proceeding under this Agreement shall be subject to the exclusive jurisdiction of the courts in England.

11. Dispute Resolution If a dispute arises between the parties, both parties agree to attempt to resolve the issue amicably through negotiation. If resolution cannot be reached, the dispute will be resolved through binding arbitration, and the decision of the arbitrator shall be final.

12. Amendments Lily Kadera Photography reserves the right to update, modify, or change these Terms of Service at any time. Any changes will be posted on our website, and the Client’s continued use of our services will constitute acceptance of the revised Terms.
